How We Capture Consent
Project Orca uses an SMS-based system to capture explicit consent before sending any marketing or
promotional messages.
Consent is obtained through user-initiated text messages in response to physical marketing
materials at
participating businesses.
1. Initial Contact: Call To Action
Physical Cards at Local Businesses
You encounter Project Orca at participating local businesses through printed cards displayed near the
cash register.
These cards clearly display:
The business's deal promise (e.g., "Tell your friends and get 50% off")
A QR code to participate
A statement: "By scanning this code, you agree to the Terms and Conditions at orca614.com"
When you scan the QR code with your smartphone's camera, it pre-fills an SMS message
but does not send it automatically.
You must manually review and send the message to provide consent.

2. Express Consent: Sending the SMS
You provide consent when you manually send the pre-filled text message. This is critical
for A2P 10DLC compliance:
User-initiated: The QR code does not automatically send a message. You must press
"Send" on your phone.
Express consent: By sending the message, you explicitly request to participate in the
deal campaign.
Consent timestamp: Our system logs the exact date and time you sent the message as
proof of consent.
Phone number verification: Sending the SMS proves you control the phone number.
3. Consent Confirmation: First Response

After you send your initial message, our system automatically responds with clear information about what
you've consented to:

4. Continued Consent: Sending a Photo
When you send a photo in response to our message, you are continuing your participation and reaffirming
consent.
At any point in the process, you can reply "STOP" to withdraw consent and end the campaign.
5. Friend Consent: Web-Based Opt-In
When Friends Click Your Shared Link
When you share your campaign link with friends and family, they see your photo and an option to claim a
secondary deal.
Friends provide consent through a web form that includes:
A phone number input field
A checkbox: "I agree to the Terms and Conditions"
Links to our Terms and Conditions and Privacy Policy
Friends must check the box and submit the form to provide consent. They will then
receive an SMS with their coupon QR code.
This web-based consent is logged with timestamp, IP address, and checkbox status.

Your Consent Rights
Opt-Out at Any Time
You can withdraw your consent and stop receiving messages at any time by:

Important: Opting out terminates your active campaigns immediately. If you were working

your progress will be lost. You will need to start a new campaign from the beginning if you choose to
participate again.

Incoming message logs: Complete record of all messages received, including timestamp

Business Partner Messaging
When you participate in deals from local businesses through Project Orca:
All messages come from Project Orca: Messages are sent through our Twilio account and
A2P 10DLC registered infrastructure
Businesses cannot message you directly: Local businesses do not have access to your
phone number
Campaign-specific consent: Your consent is tied to the specific deal campaign you
initiate
One campaign at a time: You can only earn one coupon at a time per business deal
Opting out terminates the campaign: If you text STOP, your active campaign ends and
progress is lost
Businesses receive credits when coupons are redeemed, but have no direct messaging capabilities or access to
customer contact information.

Frequency: Message frequency varies based on your participation:
Campaign Participants
Initial response: 1 message after you send the keyword
Count updates: 1 message each time you text "COUNTS"
Content flags: 1 message if photo is flagged as NSFW
Coupon delivery: 2 messages when you complete requirements (confirmation + QR code
link)
STOP response: 1 confirmation message
Typical campaign: 4-6 messages total from start to coupon redemption
Friend Referrals
Coupon delivery: 2 messages (congratulations + QR code link)
Business Users
Verification: 1 message with verification code during account setup
Notifications: Occasional messages about deals, credits, and account status
Charges: Message and data rates may apply based on your mobile carrier's plan. Project Orca

not charge for SMS messages, but your carrier may apply standard SMS rates.

Opting out immediately terminates all active campaigns and stops all messages. Progress toward coupons

Our automated content moderation uses Sightengine to screen for NSFW content. You can resubmit a
different photo.
Message Delivery: All messages are sent via Twilio's A2P 10DLC infrastructure with
delivery tracking.
If you don't receive a message within a few minutes, check your spam/blocked messages folder or text
HELP for support.
